What Is the False Claims Act?
The False Claims Act is America’s first whistleblower law and has seen many revisions since it was originally signed into law in 1863. It was passed to protect the government against fraud during the Civil War.77
Under the False Claims Act, the qui tam (or whistleblower) provision allows any individual or organization (known as the relator or whistleblower) who finds out about fraud to file a lawsuit on behalf of the U.S. government. It protects the whistleblower from retaliation. It also gives the government the right to intervene and join the action.
Over time, the False Claims Act has been expanded to apply to conduct that occurred outside of the U.S. – in cases where there was federal spending, contracting, and procurement.
Who Can File a Qui Tam Lawsuit?
Under the False Claims Act, anyone can file a qui tam lawsuit if they have evidence or information that wrongful acts were committed to defraud the government. This includes non-U.S. citizens and non-governmental organizations (NGOs).
However, you do not have grounds to file a qui tam lawsuit if another private party or the government has already filed using the evidence you have.
